The following General Terms and Conditions (GTC) apply to the sale of goods by Naturaleza GmbH (hereinafter also "Naturaleza", "we" or "Seller") via our online store at &-naturprodukte.ch (hereinafter also "Shop" or "Website") in the version valid at the time of conclusion of the contract.
- VERTRAGSSCHLUSS
(1) The presentation of goods on our website is merely a non-binding invitation to visitors to our store to submit a purchase offer to us. Sending the order in the webshop by clicking on the "Buy" button constitutes a binding offer on the part of the visitor to conclude a purchase contract.
(2) We confirm receipt of the order immediately by means of an automatically generated email ("confirmation of receipt"). This message does not constitute acceptance of the offer to conclude a purchase contract. An effective purchase contract is only concluded upon receipt of a further email ("shipping confirmation") or by sending the ordered goods.
(3) The contract is concluded with Naturaleza GmbH, Seestrasse 113a, 9326 Horn, Switzerland.
- PRICES AND PAYMENT
(1) The prices quoted are in CHF including the statutory value added tax plus the indicated shipping costs. The prices stated at the time of the order apply.
(2) The buyer (hereinafter also referred to as the "customer") has the option of paying for the goods by Twint, Post Finance, Post Card, purchase on account or prepayment QR code payment slip to pay.

(4) Naturaleza encrypts all your information with SSL (Secure Socket Layer) protocol. This means that unauthorized persons are not granted access to your data.
(5) Naturaleza GmbH reserves the right to obtain credit information about the customer in order to protect its own interests in the context of purchase processing and may forward customer data to third parties for this purpose.
For this purpose, the personal data required for a credit check (first name, surname and address data) are transmitted to an external credit agency. CRIF AG, Hagenholzstrasse 81, 8050 Zurich, Switzerland, carries out a corresponding assessment of creditworthiness and credit standing based on mathematical-statistical procedures. The resulting information on the statistical probability of a payment default is included in the decision on the establishment, execution or termination of the contractual relationship.
The credit check is carried out in compliance with the relevant data protection regulations and with special consideration for your legitimate interests. Please note that only CRIF AG can provide information about which data was used to calculate your creditworthiness profile.
If the claim is not settled even after the reminders have been sent, Naturaleza GmbH reserves the right to assign the claim to third parties or to commission debt collection at the customer's expense.
Disclosure of personal data:
Your personal data will be passed on to the transport company commissioned with the delivery or the corresponding financial service provider as part of the contract processing, insofar as this is necessary for the delivery or payment of the goods.
- LIEFERUNG
(1) The delivery of goods shall be made by dispatch to the delivery address specified by the Buyer. In exceptional cases, delivery bottlenecks or other unforeseeable circumstances may result in longer delivery times than those specified. In particular, we have no influence on delivery delays caused by the shipping company. In the case of foreign orders, delivery may be delayed accordingly.
(2) The specified delivery period begins with receipt of payment.
(3) The delivery costs are borne by the buyer.
(4) You cannot collect the goods directly from the address of Naturaleza .
- EIGENTUMSVORBEHALT
We reserve title to the goods until the purchase price has been paid in full.
- REGISTRATION ON OUR WEBSITE
(1) Naturaleza gives the customer the opportunity to register and open a customer account by clicking on the "Register" button. Registration is purely voluntary in order to simplify future orders. Registration is not mandatory in order to execute orders.
(2) The customer is obliged to treat his personal access data confidentially and not to make it accessible to unauthorized third parties.
(3) Registration with Naturaleza GmbH is free of charge. There is no entitlement to registration. We may also make registration subject to further requirements (z.B. verification of registration data). The customer is obliged to provide correct and accurate information when registering. Changes to the data should be communicated by the customer to avoid costs if the customer wishes to place a new order. In particular, the customer must provide his full name, address and e-mail address. Naturaleza is entitled to effectively send declarations to be made to the customer to the customer's e-mail address, unless a stricter form is prescribed by law or agreement.
(4) The personal data stored during registration will be saved by us so that the customer can log in again at any time using their access data. (5) A minimum age of 18 years is required to register and order on our website. You must confirm that you are at least 18 years old.
- RIGHT OF WITHDRAWAL (APPLICABLE ONLY TO CONSUMERS RESIDENT IN THE EU)
Consumers residing in a Member State of the European Union (EU) have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
DISCLAIMER:
You have the right to withdraw from this contract within 90 days without giving any reason.
The withdrawal period is 90 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

You may inform us of your decision to withdraw from this contract by means of a clear statement (z.B. a letter sent by post, fax or e-mail).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
CONSEQUENCES OF WITHDRAWAL:
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the 90-day period has expired. We will bear the costs of returning the goods if the delivery is incorrect or defective. In the case of returns of correct deliveries, the customer must bear the delivery costs of the return themselves.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functioning of the goods.

EXCLUSION PRIOR CANCELLATION OF THE RIGHT OF WITHDRAWAL:
The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
Furthermore, the right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;

- HAFTUNGSAUSSCHLUSS
(1) The Seller shall be liable without limitation for intent and gross negligence. In the event of simple negligence, the seller shall only be liable for damages resulting from injury to life, limb, health or a material contractual obligation (obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely).&
(2) In the event of a simple negligent breach of material contractual obligations, the Seller's liability shall be limited to the amount of foreseeable, typically occurring damage. Otherwise, the Seller's liability is excluded.
(3) Attention: If you have ordered one of our tinctures please note that the oil may leak if oil gets into the thread during transportation. We therefore recommend that you do not transport the oil.
(4) The above limitations of liability also apply in favor of the legal representatives and vicarious agents of the seller.
(5) The above limitations of liability shall not apply if the Seller has fraudulently concealed a defect or has assumed a guarantee for the quality of the goods. The same applies to claims of the Buyer under the Product Liability Act.
- ELEKTRONISCHE KOMMUNIKATION
(1) The Buyer expressly agrees that communication between him and Naturaleza shall take place electronically, in particular via unencrypted e-mail. The buyer is aware that unencrypted e-mails only offer limited security and confidentiality.
(2) The buyer must ensure that the e-mail address provided by him for order processing is correct so that the e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.
- SCHLUSSBESTIMMUNGEN
(1) The Buyer's General Terms and Conditions (GTC) shall not become part of the contract, even if Naturaleza does not expressly object to them.
